Start Strong Kit Agreement

Please read it carefully before signing, because you are making an important commitment to working 1-on-1 with Jette Stubbs

1. You are securing ONE of a limited number of places Jette Stubbs offers in the Career Coaching Program.
2. The price for services of $499 payable:
   a) Upfront in a one-time payment of $499
   b) In four monthly installments of $150
   c) Or in 6, 12 or 24 flexible installments via Affirm, After Pay or Klarna 
3. We make it easy to understand what it is like to do business with Jette Stubbs. Please check out the Company Terms of Service before signing this Agreement. Those policies are part of this Agreement even though they are not spelled out in this document. 
4. This Agreement and the Company Terms of Service rules are the entire agreement between us. These written documents supersede our prior discussions, emails, online or voice messages. By signing, you agree that there is no information that you deem materially important that is not incorporated into this Agreement. 

THIS IS WHAT YOUR PROGRAM INCLUDES

1. Resources. You will get access to a list of resources curated by Jette Stubbs tailored to your career needs which may include online courses, books, podcasts, training, templates, scripts and presentations. These are for your personal use and not to be shared or repurposed. These resources will be permanently available to you and will provide additional guidance after the sessions are completed. 

THESE ARE *NOT* INCLUDED

1. Services. Done-for-you services of any kind are not included. 
2. Ownership of Written Materials. 

As a participant, you will have one license to view written materials provided by Jette Stubbs. The program is copyrighted and original materials that have been provided to Client are for Client’s individual use only and a single-user license. You do not have ownership of this information, which is protected by federal copyright laws. You are not authorized to use any of Jette Stubbs and affiliates’ intellectual property for your business purposes. Some of the information is also protected by a contractual license between the provider and The Happy Career. You may not copy, re-engineer, distribute, or otherwise provide access to this information to any other person, for free or paid, without express written consent of The Happy Career, which it may withhold for any reason, and purchase of a license (prices start at $20,000). Further, by purchasing this product, you agree that if you violate, or display any likelihood of violating, any of the agreements contained in this paragraph, Jette Stubbs and affiliates will be entitled to injunctive relief to prohibit any such violations and to protect against the harm of such violations.

3. Trademark Usage. 

The Happy Career, Happy Career Formula and Jette Stubbs protects its names. You are not receiving permission to use trade and service marks like The Happy Career or any other trademark of the Company, even if not listed here. 

4. Results Not Guaranteed. You are receiving a space in the program, support and guidance, but not guaranteed results from participating in the program. 

Additional Legal Terms

1. Disclaimer of Warranties. 

Participant understands the Group Program is offered on an “as-is, where-is” basis, without any implied or express warranty as to its performance or to the results that may be obtained by using the program. This limited warranty is the only express warranty made to you and is provided in lieu of any other express warranties (if any) created by any documentation.

You understand Jette Stubbs (herein referred collectively to as "Consultant"), The Happy Career and it’s affiliates, is not an employee, agent, lawyer, doctor, manager, therapist, public relations or business manager, registered dietician, or financial analyst, psychotherapist or accountant.

You understand that Consultant has not promised, shall not be obligated to and will not;

(1) procure or attempt to procure employment or business or sales for Client;
(2) Perform any business management functions including but not limited to, accounting, tax or investment consulting, or advice with regard thereto;
(3) act as a therapist providing psychoanalysis, psychological counseling or behavioral therapy;
(4) act as a public relations manager
(5) act as a publicist to procure any publicity, interviews, write-ups, features, television, print or digital media exposure for Client;
(6) introduce Client to Consultant’s full network of contacts, media partners or business partners.

You understand that a relationship does not exist between the parties after the conclusion of this program. If the Parties continue their relationship, a separate agreement will be entered into.

2. If we get sued due to something you did:

You agree to indemnify, defend and hold harmless The Happy Career, Happy Career Formula, Jette Stubbs, its affiliates, successors and assigns from and against any and all claims, damages, losses, liabilities, lawsuits, costs and expenses (including attorneys’ fees at all tribunal levels) arising out of or related to any activity, work, or other thing done or permitted to be done by you where such liability arises from negligence on your part or the violation of this Agreement.  This includes any liability arising from a breach of confidentiality by any party. 

3. Damages are limited under this Agreement.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COMPANY WILL NOT BE LIABLE TO YOU FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF BUSINESS, LOSS OF OPPORTUNITY COST, LOSS OF PROFITS AND THE LIKE), WHETHER BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, EVEN IF COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. DAMAGES, INCLUDING ATTORNEY’S FEES AND COSTS, ARE LIMITED TO THE AMOUNT PAID UNDER THIS AGREEMENT. 

4. No Professional Advice.

The Company does not engage in the rendering of legal, accounting, financial, or other professional services. You acknowledge that you will make your own decisions before acting on any information gained from this program. It is further understood that before you utilize any techniques suggested by this program, you should consult licensed professionals as applicable.

5. Methods of Payment

If you elect to pay by monthly installments, you authorize the Company to charge your credit card or debit card. If you elect to pay in FULL, you may pay by credit card or debit card.

6. No Guarantee of Results; Risk of Loss. 

Results from the group program are greatly dependent upon individual decisions, abilities, and other factors outside the Company's control, and the Company makes no guarantees or warranties that information provided to you through the Program will provide results other than those outlined in the money back guarantee.

7. Client Responsibility

Program is developed for strictly educational purposes ONLY. You accept and agree that you are 100% responsible for their progress and results from the Program. Jette Stubbs and affiliates makes no representations, warranties or guarantees verbally or in writing. You understand that because of the nature of the program and extent, the results experienced by each client may significantly vary. You acknowledge that as with any business endeavor, there is an inherent risk of loss of capital and there is no guarantee that you will reach your goals as a result of participation in the Program. Program education and information is intended for a general audience and does not purport to be, nor should it be construed as, specific advice tailored to any individual. Jette Stubbs and affiliates assumes no responsibility for errors or omissions that may appear in any program materials. 

8. Jette Stubbs can end your participation in the program. 

Company may determine, in its sole discretion and without requiring disclosure of the reason, that the relationship under this Agreement must terminate. In this circumstance, the Company will provide a partial refund of up to 50% of enrollment.  

9. The Ontario law governs this Agreement and it will be enforced by either party in Canada. 

This Agreement will be governed by the laws of Canada, without regard to its conflicts of law principles. I understand and agree that I submit to the personal jurisdiction and venue of this state and agree that any legal proceeding commenced shall take place in Ontario, Canada.

10. No Assignment; No oral waivers or modifications.

This Agreement may not be assigned to any other party. Its requirements may not be waived or modified except in writing signed by the Company. 

11. Electronic Signatures and Other Documents. 

You agree that your electronic signature is valid and binding evidence of your assent to the terms of this Agreement. You agree to sign additional documents which may be necessary to complete the material purpose of this Agreement, including without limitation, payment authorizations. 

12. No relationship.

The parties hereto expressly understand and agree that they are not employers or employees, principals and agents, or partners or co-venturers in the performance of each and every part of this Agreement, and they remain solely responsible for all of their respective employees and agents.

Multimedia Waiver: During the course of The Program, photographs, audio, and video may be taken and edited which may or may not include You. You agree to allow the use of these to The Happy Career, Happy Career Formula, Jette Stubbs and its representatives to be used in marketing content online and/or offline.
